As questions of care, undue influence, and fiduciary responsibility continue to shape disputes after death, this seminar will explore the legal and practical challenges that emerge when decisions made during a person’s lifetime come under scrutiny.
The session will consider key issues spanning both Court of Protection and contentious probate practice, including the use of powers under a property and financial affairs lasting power of attorney, care decision making, the impact of lifetime gifts and transactions, concerns about testamentary capacity, disputes over executor appointments, and the rights of disappointed beneficiaries.
