Legal orders for immediate safety and protection

Understanding the legal protections available to you is essential in safeguarding yourself and your loved ones from domestic abuse. Anthony Gold Solicitors offers urgent support to help you secure the following protective orders:

Non-molestation orders & DAPO’s

Non-molestation orders and DAPO’s are  designed to protect you from further abuse. These orders can be tailored to stop various abusive actions, including:

  • Physical violence
  • Threats of harm
  • Coercive control and intimidating or controlling behaviour
  • Sexual abuse
  • Psychological/emotional abuse
  • Financial/economic abuse
  • Damage to property
  •
  • Harassment and stalking including  unwanted contact in person, by phone, or online through social media

In addition to the above, a DAPO can also impose electronic monitoring on an abuser and require the abuser to attend a course or programme.

If you are in immediate danger, a non-molestation order or DAPO can be requested urgently, in some instances on the same day. We will advise you on whether to apply for a non-molestation order or DAPO, depending on your circumstances. Our team will guide you through the application process, ensuring you understand each step and that all necessary evidence is presented effectively. Violating a non-molestation order or DAPO is a criminal offence, which means the police can act swiftly if your abuser does not comply.

Occupation orders

An occupation order helps protect you by regulating who can live in or enter your home. This can be particularly important if you share a residence with your abuser, as it allows the court to determine:

  • Who is allowed to live in or enter the property
  • Specific areas within the home that the abuser must avoid
  • Conditions preventing the abuser from coming near your residence

Occupation orders provide a critical layer of security, granting you the right to stay in your home while restricting or removing the abuser’s access. Depending on your circumstances, the court can tailor these orders to include specific protective measures, such as exclusive occupancy, ensuring you and your children feel safe in your own home. Our solicitors will work with you to gather the relevant information and present a compelling case to the court for the protection you need.

Prohibited steps orders

Prohibited steps orders can be used to ensure a child’s safety, preventing a parent or guardian from making specific decisions or taking actions that could endanger a child. This order is particularly useful if:

  • You fear your abuser may attempt to take your child out of school, from their home, the country, or your care.
  • There are concerns about the abuser’s influence or control over the child’s well-being and daily routine

The court can issue a prohibited steps order to block certain actions, like removing your child from your care or making decisions about their schooling and healthcare without your agreement. This order may be vital in protecting your child from potential harm or coercion, especially in high-risk situations. Our team can move quickly to secure an order and ensure your child’s rights and safety remain a priority.

Domestic abuse & injunctions: FAQs

How quickly can I get a non-molestation order?

A non-molestation order can be obtained on an urgent basis, often within a few weeks if there is an immediate risk of harm. In cases of severe urgency, the application can be made “without notice,” meaning it can be processed without the abuser being informed initially, to ensure your safety. Our team at Anthony Gold Solicitors will guide you through this process swiftly, ensuring all necessary documentation and evidence are in place for a quick response.

What evidence do I need to apply for a non-molestation order?

To apply for a non-molestation order, you will need to provide evidence of the abuse or harassment you have experienced. This can include witness statements detailing the abuse, police reports, medical records if you sought treatment for injuries, messages or emails showing threatening behaviour, and any other documentation which demonstrates a pattern of controlling, intimidating, or harmful actions. While detailed evidence strengthens your case, you can still apply for an order based on your account alone, and the court will take all circumstances into consideration.

Can I get an occupation order if I still live with my abuser?

Yes, you can apply for an occupation order even if you still share a home with your abuser. An occupation order can legally prevent the abuser from entering or remaining in the home, or restrict their access to specific areas, making your living environment safer. The court will consider factors like housing needs, financial resources, and the impact on all parties before granting the order. We can help you present a strong case to ensure the best chance of obtaining the protection you need.

Can I protect my children with a prohibited steps order?

Absolutely. A prohibited steps order can be used to protect children by restricting specific actions by a parent or guardian that may place them at risk. This can include preventing your abuser from removing your children from school, taking them out of your care, or making certain decisions about their welfare. Our solicitors can help you apply for this order swiftly to ensure your children’s safety and stability.

Do I need a solicitor to apply for an injunction?

While it is possible to apply for an injunction on your own, having a solicitor significantly improves your chances of success, especially if you need urgent protection. A solicitor can help gather evidence, prepare your application, and ensure your case is presented effectively. At Anthony Gold Solicitors, we offer experienced legal support to make the process smoother and less stressful, providing reassurance that every detail is handled professionally.
