When concerns arise as to a Personal Representative’s ability to properly administer an estate, one option – which is becoming increasingly prevalent – is to seek to replace them with an Independent Administrator. This seminar explores the legal and practical issues that arise whenseeking to replace a Personal Representative, and the options available both before and after removal.
Tom Dickinson and Elliot Booth will consider the Court’s current approach to removing Personal Representatives with reference recent case law , and what this means in practice for beneficiaries and Personal Representatives . They will also explore the role of an Independent Administrator and the steps that can be taken to resolve claims and disputes between the beneficiaries and/or former Personal Representatives.
