Where there isn't enough money in an estate to cover debts you may need experienced help to guide you through what can be a tricky and time consuming process.

Once probate has been granted, all the assets of an estate need to be collected and any debts paid before it can be distributed.  This sounds straightforward, but if there isn’t enough money in the estate to pay the debts it could get tricky, and because you can’t claim for the time taken or work involved in administering an estate, which can be considerable, you could end up seriously out of pocket.

On the other hand, a professional executor, such as solicitor, can charge fees for the time they spend administering an estate.  They will also be fully aware of their legal responsibilities and clear about exactly what needs to be done and when, leaving family members able to get over their loss and get on with their lives.
