Make an Islamic Will this Hijri New Year


This Hijri New Year, make it your intention to put your Islamic Will in place.
It’s one of those tasks that we constantly put off – whether it’s because we don’t like to think of death, or simply because we are too busy to think about it.
However, having a valid Will in place is not only advisable from a legal perspective, but also an Islamic one.
An Islamic Will allows you to:
- Specify how your estate should be distributed based on the Islamic inheritance rules.
- Make a bequest of the ‘freely disposable third’ of your estate to someone of your choice.
- Appoint guardians to raise your children, should there be nobody with parental responsibility on your death.
- Set out your funeral wishes to make sure these happen in accordance with your Islamic principles.
- Make provision for unpaid zakat or outstanding debts on your death, before the distribution of your residuary estate.
- Allocate a proportion of your estate as sadaqah, to continue to benefit you after death.
- Include a request that someone performs Hajj on your behalf if you were not able to do this before your death.
In the event that you do not have a valid Will in place at the time of your death, your assets will pass according to the fixed intestacy rules set out in the law. The shares of inheritance set out in the intestacy rules are not reflective of the Islamic position, which may be a cause of concern for you if you wish for your estate to be dealt with according to Islamic principles.
