Practice and Procedure in the Business and Property Courts, a review by Clifford Tibber
Clifford Tibber has reviewed the Law Society’s recently published Litigation Handbook, Practice and Procedure in the Business and Property Courts. Full review can be found below.
“The preface to Adam Chaffer’s practice and procedure in the Business and Property Courts says that “this book charts a dispute through the court process from the pre-action stage to resolution via either a trial or settlement through an alternative dispute resolution method” and it does just that “encapsulating for the reader the process of litigation from start to finish”.
Wisely avoiding coverage of costs and litigation funding this handbook opens with a brief history of today’s civil justice system followed by a look at the overriding objective. The author then embarks on an explanation of the various stages of civil procedure incorporating practical tips for all parties at the pre-action stage to drafting techniques for statements of case and advice on the form and content of witness statements. He then looks at practical considerations for trial preparation; settlement and appeals and finally a look at the most common interim applications
Combining references to CPR and relevant case law and with helpful commentary on all the key stages of civil litigation this handbook should be regarded as a vital tool to navigate this increasingly complex subject to all those starting out in world of civil litigation.”
