Resolving differences through negotiation is nearly always preferable to taking legal action, whether in an Employment Tribunal or court.
However, issuing a legal claim is sometimes necessary, either to protect the position of the member or the union while settlement options are explored, or where the employer refuses to engage or agreement cannot be reached.
