Many individuals rely on Health and Social Services to support them with meeting the cost of care, whether that be to meet the cost of care at home (in the community) or in a care home.

To help maximise care funding income for our clients, we provide advice on individual entitlement and eligibility to secure:

  • Social Services funding from Local Authorities;
  • NHS Continuing Health Care (CHC) and;
  • s.117 After Care funding.

We are aware that access to funding is becoming increasingly difficult to secure given the public funding changes and care crisis. Care funding can be incorrectly denied, and/or an individual’s needs may be under assessed. This can leave individuals vulnerable and at risk of harm.

 

Disputes and Appeals

The rules around accessing care funding can be complex and difficult to navigate. We understand that the process of disputing a decision made by health and social services can be stressful. We can advise and support on disputing decisions and where required, formally appeal decisions.

We are also able to advise Deputies on when they might require specific authority from the Court of Protection to pursue a specific funding outcome for their clients.

We have significant experience in navigating access to funded care outside of a compensation award, in order to maximise a client’s income, including advising on reverse indemnities contained within damages orders, and their potential impact on an individual’s care funding claim.

 

Deprivation of Assets

The existence of property and savings can also create difficulties around accessing funding. We can advise on how to avoid a deprivation of assets and provide representation when a deprivation might be incorrectly alleged.

We understand the importance of acting quickly to ensure concerns around care are raised and addressed as quickly as possible so that individuals can move on and enjoy their lives without having to worry about how their care needs will be met.  We act as a Professional Property and Affairs Deputy for many clients who have complex needs and have extensive experience in managing, claiming and challenging health and social services decisions.
