On Friday 25th June 2021, our “COP Conversations: in what circumstances might a deputy or attorney be removed” episode went live. Host, Partner and joint Head of Court of Protection, Alexandra Knipe was joined by guest speaker Holly Mieville-Hawkins.
Holly is a passionate defender of the rights of people who lack the mental capacity to make certain decisions for themselves. Holly is a founding member of the practitioner group that established the Mediation in the Court of Protection pilot scheme, and is currently a member of the Wills and Equity Committee at the Law Society; a member of the South West Court of Protection Practitioners Association and a stakeholder at the Office of the Public Guardian. The issues Holly helps to resolve range from appointing deputies and attorneys, and questions about day-to-day financial management and gifting, to matters relating to the capacity to marry, purchasing and selling property and making a will.
The COP Conversation episode sees Alexandra and Holly discuss the circumstances  when a deputy or attorney might be removed. The podcast looks at grounds of removing an attorney or deputy under EPA and LPA. Holly also speaks about the consequences of removing a deputy or an attorney.
Reflecting on the podcast, Holly said: “’It was a real pleasure to speak to Alexandra about all things Court of Protection, and an honour to be asked. Alexandra has an encyclopaedic knowledge and experience of the deputyship and attorneyship world, and it was a joy to record this podcast and get into the nitty gritty of what to do when things go wrong.”
These conversations are vital to supporting and protecting the future of vulnerable clients as well as ensuring they obtain the right amount of funding to help meet their accommodation needs.
Commenting on the podcast, Knipe said: “Holly is a fantastic lawyer, with a real passion to secure the very best outcomes for her clients. Holly is at the forefront of developments in this area and  her practical approach to providing solutions in these difficult circumstances is refreshing”.
Don’t miss out on our COP Conversations. New episodes are released monthly on the last Friday of the month.
