About Holly Miéville-Hawkins

Holly joined the firm in March 2025, and is a non-member Partner in the Court of Protection (COP) team. She has almost 15 years of expertise in COP matters, having always specialised in this complex area of law.

Holly has a national reputation for her work, and is recognised in legal directories; she’s dedicated to helping vulnerable individuals and their families. Her practice focuses on complex finance and property matters in the UK and internationally, including the appointment of deputies and attorney, buying and selling property, litigating, advising attorneys and deputies, attorney and deputy removal, getting married or divorced, to making a will and gifting. She is passionate about protecting vulnerable individuals from becoming victims of financial abuse. She also specialises in care fee planning and provision, disputes about welfare, deprivation of liberty, and where a person should live.

Holly’s extensive qualifications include a full STEP diploma, which is the professional body for trust and estate practitioners, and the Older Client Care in Practice qualification from the Association of Lifetime Lawyers. She is a founding member of the practitioner group that established the Mediation in the Court of Protection pilot scheme and a committee member, and former Deputy Chair, of the Mental Capacity Special Interest Group, for STEP.

She has written many articles for STEP and was involved in the recent launch of its ‘Spot the Signs’ campaign, which highlights the warning signs of financial abuse to help protect those at risk. She has also regularly delivers talks and training nationally, and has been published across various other professional media outlets, including Legal Futures and The Law Society.

Notable case work

Disabled Persons Trust

We acted for a father of a young lady with learning disabilities, drafting a Disabled Person’s Trust to provide for her during his lifetime and after his death without affecting state support, with remaining funds passing to his other children.

Urgent Statutory Will

We acted for an elderly woman with family across multiple jurisdictions and significant assets in England and Wales. As it was unclear whether she had a valid Will, we urgently applied for a Statutory Will, which was granted, ensuring proper administration of her estate.

Advice regarding care

We acted for the attorney of a woman with significant care needs, assisting with mental capacity and care assessments after her needs changed, and advising on the Local Authority’s duties and the procedures required before any changes to care provision.
