Past event: Deputies and attorneys in civil litigation

Leading practitioners David Wedgwood and Holly MiƩville-Hawkins from our Contentious Probate and Court of Protection teams recently hosted a seminar on the role of deputies and attorneys in civil litigation. The session examined the practical and procedural aspects of litigation capacity, provided an overview of the Part 21 process, and clarified what constitutes litigation in a legal context.

The discussion also covered the qualities of a suitable litigation friend, the authority required for the role, related costs, and the responsibilities of deputies and attorneys when proceedings arise.

A practical case study illustrated key steps in managing various types of disputes, including handling a contract dispute, addressing a financial issue such as property repossession, and responding to a non-financial matter such as defamation or libel.
