Jenny Kennedy successful in High Court trial for client paralysed in M25 motorcycle accident


Following a three-day liability trial in June, HHJ Nicholas Braslavsky QC, Judge of the High Court, found in favour of Jenny’s client.

Despite the defendant maintaining a full defence of liability, the judge found that the only 25% should be deducted from any future award for contributory negligence.

Jenny’s client had been exiting junction 11 of the M25 motorway when a van driver, who was established in a line of traffic on the exit slip road, chose to pull out from his lane with little warning, into the clear lane of traffic that Jenny’s client was travelling in, causing a collision between the two vehicles. Jenny’s client has been left paralysed as a result of the accident.

Now that liability has been established, the claim will now be valued. That will include elements such as loss of earnings, future accommodation and lifetime care costs.
