Cycling Accident Claims

The untimely death of Dr Marta Krawiec while she was cycling to work has once again raised questions around the safety of cyclists in London. Dr Krawiec worked as a paediatric allergy consultant and was sadly pronounced dead at the scene of the accident which recently took placed near Holborn tube station.

There has been a big increase in cycling during the Covid-19 pandemic.  However, unfortunately there has also been an increase in cycling accidents, so much so that the location where Dr Krawiec died has alone seen six cyclists killed in the past decade, and many more have sustained serious or life changing injuries.

Cyclists generally are amongst some of the most vulnerable road users, and every year thousands of cyclists sustain catstrophic injuries on UK roads. Some of these accidents can have a long-lasting and devasting impact on the injured person, and their families.

It is important to understand that all road users owe each other a duty of care to try and keep each other safe on the roads. This means that they should use the road safely and pay attention to others around them. Some individuals believe this only applies to motor vehicles, but cyclists too have the right to be safe on the roads and are owed a duty of care by other road users.

If you have had a crash or sustained injuries in a cycling accident that wasn’t your fault, you may be able to bring a claim. However, who you can bring your claim against is not always straight forward. For example, you may have sustained injuries due to poor road conditions (in which case you may be able to instigate a claim against the local council), or you may have been involved in a traffic accident (in which case you may be able to instigate a claim against the driver of the vehicle responsible for the crash). This is a complex aspect of any potential claim and needs careful consideration by experts.

If you have been severely injured because of a cycling accident or because of a road traffic accident which was not your fault, please contact our injury claims team. Our team is made up of specialist personal injury lawyers who have many years of experience in dealing with highly complex cases.
