Collaborative law is designed to keep disputes out of court, but when should counsel be brought in to assist the process? This event will explore the role of collaboratively trained barristers, when their involvement is most useful, and how they can support both clients and solicitors in achieving better outcomes.

Duncan Brooks and Tristan Harvey from QEB Chambers will lead the discussion, covering:

  • When it makes sense to involve counsel in a collaborative case—should they provide written advice, attend meetings, or be there from the start?
  • What a collaborative meeting with counsel actually looks like in practice.
  • The advantages of using the collaborative process for nuptial agreements.
  • Why collaborative law seems less common in London compared to other areas and what might help change that.
  • Whether Early Neutral Evaluation (ENE) can help break deadlock in collaborative cases and mediation.

Meet our speakers

Duncan Brooks KC, QEB Chambers  – Duncan specialises in financial provision following separation. He represents high and ultra-high net worth individuals, and is used to dealing with complexities arising from trusts, business accounts, taxation and international disputes. He regularly deals with cases involving the music, art, finance, private equity, legal, farming and business industries.  He has been a  DDJ since 2010.

Duncan has been a Family Law Arbitrator since 2013 and has concluded over 35 arbitrations as arbitrator. He has conducted more than 100 Private FDRs as the evaluator. Duncan trained as a collaborative lawyer in 2009 and is a member of Resolution.

Tristan Harvey, QEB Chambers  – Tristan is an experienced barrister specialising in dispute resolution. As a mediator he offers different models to fit the needs of his particular clients. He is accredited by the Family Mediation Council and by the Centre for Effective Dispute Resolution (CEDR) and he offers Mediation Information and Assessment Meetings. Tristan is also an arbitrator in financial and children cases, a collaborative lawyer and he conducts private FDRs and early neutral evaluations.
