What is a Lasting Power of Attorney (LPA)?

A lasting power of attorney (LPA) is a legal document that enables you to designate one or more people as your attorney(s) to make decisions on your behalf during your lifetime. There are two types: one for finances and property and another for health and welfare.

 

Who can make a Lasting Power of Attorney (LPA) for me?

As long as you have mental capacity, you can draw up an LPA. While the health and welfare LPA can only be used when you are unable to make your own decisions, the finances and property LPA can be used by your chosen attorneys at any time.

 

How do I create a Lasting Power of Attorney (LPA)?

While it is possible to draw up an LPA on your own, to ensure that the LPA is valid, it must be filled in correctly and then sent to the Office of the Public Guardian as soon as possible for registration. Only then will your LPA be useable by your attorneys.
